1. Acceptance of Terms

By accessing or using the Intelcall service ("Service") provided by Intelcall ("we," "us," or "our") at intelcall.com.au, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service. Continued use of the Service constitutes acceptance of these Terms.

2. Description of Service

Intelcall provides a communication platform offering call services, including but not limited to, automated call handling, call routing, and related telecommunication features, accessible via intelcall.com.au. The Service is subject to availability and may be modified or discontinued at our discretion, with notice provided as required by law.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service. By using the Service, you represent that you meet these eligibility requirements.

4. User Obligations

You agree to:

Provide accurate and complete information when registering or using the Service.

Use the Service in compliance with all applicable laws, including those of Western Australia and the Australian Consumer Law.

Not use the Service for any unlawful, fraudulent, or malicious purpose, including but not limited to sending spam, phishing, or other harmful communications.

Not attempt to reverse-engineer, hack, or interfere with the functionality or security of the Service.

5. Payment Terms

Fees: The Service may require payment of fees as outlined on the intelcall.com.au website. All fees are in Australian Dollars (AUD) and inclusive of Goods and Services Tax (GST) unless otherwise stated.

Billing: You agree to pay all applicable fees promptly via the payment methods provided. Failure to make payments may result in suspension or termination of your access to the Service.

Non-Refundable Fees: Unless otherwise required by the Australian Consumer Law, fees paid for the Service are non-refundable, except where explicitly stated in our Refund Policy (see Section 7).

6. Intellectual Property

All content, trademarks, and intellectual property related to the Service, including software, designs, and logos, are owned by or licensed to Intelcall. You may not copy, reproduce, or distribute any content without our prior written consent.

You retain ownership of any data or content you upload or transmit through the Service but grant us a non-exclusive, royalty-free license to use, store, and process such data solely to provide the Service.

7. Refund Policy

Under the Australian Consumer Law, you are entitled to a refund, repair, or replacement if the Service fails to meet consumer guarantees (e.g., acceptable quality or fitness for purpose).

Requests for refunds outside of ACL guarantees (e.g., change of mind) are at our discretion and must be submitted in writing to [email protected] within 7 days of the issue arising.

Non-refundable fees, such as setup or subscription fees, will be clearly identified at the time of purchase.

IntelCall offers a 30 Day Money Back Guarantee, if you have, in our discretion and in accordance with our instructions correctly used our service for 30 days, and the service does not meet your reasonable needs. In this case, IntelCall will refund all moneys paid with the exception of third party call and service charges paid by IntelCall.

8. Privacy and Data Protection

We collect, store, and process personal information in accordance with our Privacy Policy, available at intelcall.com.au/privacy-policy. This policy outlines how we manage your data, including storage within Australia or secure cloud-based systems.

You agree to comply with applicable data protection laws when using the Service, including obtaining consent for any personal information you transmit through the Service.

9. Limitation of Liability

To the extent permitted by law, Intelcall is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, except as required under the Australian Consumer Law.

Our liability for breaches of consumer guarantees under the ACL is limited, at our discretion, to resupplying the Service or paying the cost of having the Service resupplied.

We do not guarantee uninterrupted or error-free operation of the Service and are not liable for losses caused by events beyond our reasonable control, such as network outages.

The absolute limit of liability for IntelCall in any case will be the total of fees paid to IntelCall, less any expenses paid to third parties.

10. Disclaimers

The Service is provided "as is" and we do not warrant that it will meet your specific requirements or that it will be suitable for any particular purpose beyond what is guaranteed under the Australian Consumer Law.

We are not responsible for the content or accuracy of communications transmitted through the Service by you or other users.

11. Termination

We may suspend or terminate your access to the Service if you breach these Terms, fail to pay fees, or engage in unlawful activity.

You may terminate your use of the Service at any time by contacting [email protected]. No refunds will be provided for unused portions of the Service unless required by law.

Upon termination, your right to use the Service ceases, but obligations regarding confidentiality, intellectual property, and payment survive.

12. Changes to Terms

We may update these Terms from time to time to reflect changes in the Service or legal requirements. Updates will be posted on intelcall.com.au, and continued use of the Service after such changes constitutes acceptance of the revised Terms.

Significant changes will be notified to users via email or through the Service interface, as required by law.

13. Governing Law

These Terms are governed by the laws of Western Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Western Australia.

15. Compliance with Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law that cannot be lawfully excluded. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
